Awesome Bounce House and Party Rentals, LLC

Release and Waiver of Liability

 

1. The customer agrees to the company’s right to enter premises of customer at any time to repossess said equipment.

2. This rental equipment has been received in good condition and will be returned in the same condition (ordinary wear and tear is acceptable).

3.  Customer agrees not to loan, sublet or otherwise depose of equipment or use it at any other location.

4.  Customer agrees to pay in full the replacement cost, including labor, for all damages to rental equipment.

5. If the inflatable equipment is lost, stolen, or damaged beyond repair the renter agrees to pay $2,500.00 (two thousand five hundred dollars and zero cents).

6. There are no warranties of merchantability or fitness either expressed or implied. The person or organization renting this equipment from Awesome Bounce House and Party Rentals, LLC will be held responsible and liable for any and all damage or injury occurring for any reason whatsoever. I have read the above agreement and fully understand and accept the conditions above. I am aware that while in my care I am fully responsible for the inflatable and will pay for any loss or damage that may occur.

7. Customer understands and acknowledges that play on an amusement device entails both known and unknown risks including, but not limited to, physical injury from falling, slipping, crashing or colliding, emotional injury, paralysis, distress, damage or death to any participant. Customer agrees to indemnify and hold Awesome Bounce House and Party Rentals LLC harmless from any and all claims, actions, suits, proceedings, costs, expenses, fees, damages and liabilities, including, but not limited to, reasonable attorney’s fees and costs, arising by reason of injury, damage, or death to persons or property, in connection with or resulting from the use of the leased equipment. This includes, but is not limited to, the manufacture, selection, delivery, possession, use, operation, or return of the equipment. Customer hereby releases and holds harmless Awesome Bounce House and Party Rentals, LLC from injuries or damages incurred as a result of the use of the leased equipment. Awesome Bounce House and Party Rentals, LLC cannot, under any circumstances, be held liable for injuries as a result of inappropriate use, God, nature, or other conditions beyond its control or knowledge. The customer also agrees to indemnify and hold harmless Awesome Bounce House and Party Rentals, LLC from any loss, damage, theft or destruction of the equipment during the term of the lease and any extensions thereof.

Rule #1.

A responsible adult must closely supervise and be in attendance while any inflatable or piece of equipment owned by Awesome Bounce House and Party Rentals, LLC is in operation. The customer agrees to supervise the equipment for the entire time that the equipment is in the customer’s possession. Awesome Bounce House and Party Rentals may provide this service for an additional fee, but it is the responsibility of the customer to discuss this service with Awesome Bounce House prior to the equipment being delivered to customer.

 

Rule #2.

Do not use the inflatable during periods of rain or excessive wind speeds of 20 mph or greater. In the event of severe weather, (lightning, thunder, rain or high winds) instruct all occupants to immediately exit the inflatable and DO NOT allow re-entry until the weather clears. At this time, it may be necessary to unplug the blower for the electrical outlet until the weather clears.

Rule #3.

All Inflatables are physically challenging. Any person with a health impairment, disease, high blood pressure, back, neck or other bone/joint problems, or any other conditions that might cause problems when physically challenged should not be allowed in any of our inflatables.

 

Rule #4.

All participants must remove shoes, eyeglasses, jewelry and any other hard or sharp objects before entering the inflatable. In addition, no toys or pets allowed inside or on the inflatable.

 

Rule #5.

No gum, candy, food or drinks allowed inside or on the inflatable at any time.

 

Rule #6.

Please keep all hot objects such as: cigarettes and BBQ grill away from the inflatable always.

 

Rule #7.

No flips, wrestling, or other forms of rough play allowed in the inflatable. No jumping down any slide surface at any time. Do not climb walls unless they are specifically designed for that. Walls will have handles and or loops to grab if they are designed for climbing.

 

Rule #8.

 Do not overload any inflatable. Participants in a bouncer and generally all inflatables should be grouped according to age and size.

 

Rule #9.

It is the responsibility of the customer to indicate where electrical, phone, and water lines are located prior to stakes or anchors being inserted into ground. If anchors come loose or should the inflatable begin to deflate during operation, immediately and calmly instruct all participants to exit the inflatable and call Awesome Bounce House and Party Rentals 432-201-8350.
